Terms and Conditions
These general terms and conditions apply to all legal relationships between DG&Luxury als watchmodder and to all quotations, offers and agreements. DG&Luxury may change these special terms and conditions at any time and without prior notice.
In the event of an application or a change to his application, the client must take cognizance of the conditions that are valid at that time or on his own initiative.
Provisions or conditions set by the client that deviate from, or do not appear in, these general terms and conditions are only binding for DG&Luxury if they have been expressly accepted by the owner in writing.
PRICES
Prices are subject to change at any time. The changed prices will apply to all requests made after the change has been made.
If the costs increase in order to realize the wish of the assignment reasonably , this will be calculated (after consultation with the client) _cc781905-5cde-3194-bb3b-319605_bad -bb3b-136bad5cf58d_to the client.
QUOTES
All offers and personal quotations from DG&Luxury are without obligation until the moment of acceptance by the client. Quotations remain valid until 30 calendar days after the quotation date, unless stated otherwise. Each quote confirmation by de client, connects de client. The personal offer replaces any previously concluded agreement (both written and oral).
BOOKING, PAYMENT, CANCELLATION
The booking of an order bij DG&Luxury is final after written confirmation (confirmation of receipt of the approved quotation), and payment of an advance as indicated on the quotation.
As long as the payment of the stated advance has not been made and there is no written agreement, we will not regard the application as registered.
As long as the pre-established conditions have not been met (written confirmation (signing quotation) and payment of an advance), there is no question of any cooperation and/or assignment.
The amount already paid - or the parts ordered - can be withheld in the event of late cancellation of the order.
Payment of the remaining balance is made at the latest upon delivery of the end product.
Payments must be made to the following account number: DE67 1001 1001 2629 8218 68.
If the client is entitled to a (partial) refund, this will be done within 30 calendar days after cancellation of the order to the transferred account number as a credit note.
INVOICES & PAYMENTS
Payment of the advance must be made to the following account number: DE67 1001 1001 2629 8218 68.
The remaining amount (total amount minus the advance already paid) must be received at the latest upon delivery of the end product.
The client will then receive an invoice within 3 working days stating the services provided.
COMPLAINTS
All formal complaints regarding the delivery and/or performance of services must be notified by registered letter within eight days of the performance or invoice date. Receipt of the invoices is assumed to be 3 days after the invoice date.
The contrary must be proven in writing.
LIABILITY
DG&Luxury is not liable for any damage incurred by the client, unless there is intent or gross negligence on the part of DG&Luxury or its representatives.
Under no circumstances can we as a company be held liable for indirect damage resulting from any use or performance of the services, such as loss of profit or loss of data. DG&Luxury or its representative can under no circumstances be held liable for physical or material damage caused by allergies etc.
The client further agrees not to discredit, the business manager and employees , nor defame or defame,_cc781905-5cde-3194-cc781905-5cde-3194- 136bad5cf58d_or will undertake any business that may reasonably be believed to damage the personal and professional reputation of DG&Luxury and the people associated with the company.
INSURANCE
Before, during and after the assignment, each individual is liable for himself. We as a company stand for freedom of expression. If complications arise during the execution of the assignment that could endanger DG&Luxury or its representative, it is the choice of each party to allow this or not. DG&Luxury will therefore not be responsible for any accidents.
CAVEAT
DG&Luxury has the right to refuse an order if, after acceptance, new information becomes available that makes execution impossible or unacceptable. An assignment can also be stopped after acceptance if the client has not taken the requested actions and/or preparations. In these cases we are forced not to transfer the already paid advance back to the client.
FORCE MAJEURE SITUATIONS
In the event of illness or force majeure we will make the efforts to engage a colleague who works_cc781905-5cde-3194-bb3b-136bad5cf58d-781905_bad_at the same agreed rate which will deliver an equivalent result and we will offer compensation for this inconvenience. In the event of force majeure or technical problems, the client agrees, and no judicial steps can be taken. No (emotional) compensation will be paid.
BEHIND THE SCENE'S
In some cases, images may be made of the client in question during the performance of the services. This will be discussed in advance whether they agree or not (via email) for publication on social media (Facebook, Instagram, website, etc.)
PRIVACY
DG&Luxury will under no circumstances pass on or disclose personal data (e-mail, telephone, address, etc.) to third parties.
